This action arises from the unauthorised usage of "Pink 3" by Everest Corporation (also known as "EverestCorp"). The Petitioner, LEIGH ROTHSCHILD, hereby seeks damages, injunctive relief, and restoration of proprietary rights to the aforementioned intellectual property.
"Pink 3" constitutes a unique and valuable asset, developed and maintained exclusively by the Petitioner with sponsorship from his company DISPLAY INCORPORATED. The Defendants have, without consent, license, or compensation, incorporated "Pink 3" into their commercial "Celestecord" platform, thereby infringing upon Petitioner's exclusive rights and causing measurable harm to their professional reputation and brand equity.
The Defendants' actions constitute willful infringement, breach of community standards, and violation of Discord's Terms of Service.
The Petitioner, LEIGH ROTHSCHILD, with sponsorship from his company DISPLAY INCORPORATED invented the colour Pink 3 on the 5th of June, 2019.
The patent for Pink 3 was filed by LEIGH ROTHSCHILD in late 2022.
Pink 3 was implemented by the Defendant as an "April Fools" joke, on the 1st of April, 2026.
Without authorisation, consent, or acknowledgment, the Defendants incorporated "Pink 3" into their platform, making it available to the general public.
As a result of this infringement, the Petitioner has suffered:
- Loss of exclusive control over "Pink 3"
- Reputational damage
- Emotional distress
- Loss of potential licensing fees
The Defendants have profited substantially from this unauthorized use and have shown no remorse or willingness to rectify the matter.
The Petitioner hereby requests the following remedies:
- Immediate removal of all instances of "Pink 3" from the "Celestecord" platform and any derivative works.
- Monetary damages in the amount of $8,500,000USD for loss of exclusive rights and emotional distress.
- A formal written apology to be posted in the Celeste Discord #general channel, pinned for a minimum of 90 days.
- Mandatory rebranding of EverestCorp to "NotPink3Corporation" for a period of 5 years.
- The Defendants shall acknowledge Petitioner's exclusive ownership of "Pink 3" in perpetuity, in all public communications and documentation.
